1. Introduction & Overview

These Terms and Conditions (“Terms”) govern your relationship with Spanish Circle (“we”, “us”, or “our”) when accessing our website https://spanishcircle.co.uk/ or purchasing/enrolling in any of our tuition services, including in-person sessions (“Spanish & Coffee”), private 1-to-1 tuition, and online courses.

By booking a course, purchasing tuition, or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. Services & Bookings

Spanish Circle provides Spanish language instruction across different formats:

  • In-Person Lessons (“Spanish & Coffee”): Conducted at designated social/community venues.
  • 1-2-1 / Private Tuition: Tailored private sessions delivered online or in person.
  • Online Courses: Self study and scheduled group lessons delivered via digital video conferencing platforms.

All bookings are subject to availability and acceptance by Spanish Circle. We reserve the right to decline any booking request at our discretion.

3. Fees, Payments & Subscriptions

All fees are quoted in British Pounds Sterling (GBP £) and are payable in advance of lesson delivery unless otherwise agreed in writing.

  • Payment Methods: Payments are processed securely via approved third-party gateways (such as Stripe, PayPal, or bank transfer).
  • Course Materials: Unless explicitly stated otherwise, digital teaching materials are included in the tuition fee.
  • Price Changes: We reserve the right to modify our course fees. Any fee adjustments will be communicated prior to booking confirmation and will not affect pre-paid blocks or active bookings.

4. Statutory Right to Cancel (14-Day Cooling-off Period)

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK), consumers who purchase courses online or at a distance have a statutory right to cancel their contract within 14 days without giving any reason.

  • The cancellation period expires 14 days after the day the contract is concluded (booking confirmation).
  • To exercise this right, you must notify us via email at hello@spanishcircle.co.uk.
  • Immediate Service Request: If you request lesson delivery to begin during the 14-day cooling-off period, you acknowledge that you will pay for any lessons delivered prior to cancellation, and you waive the right to cancel if the service is fully completed within this period.

5. Rescheduling, Cancellations & Absence Policy

Outside the statutory 14-day cooling-off period, the following operational cancellation policies apply:

  • 1-2-1 / Private Sessions: Cancellations or rescheduling requests must be submitted in writing at least 24 hours prior to the scheduled lesson. Lessons cancelled with less than 24 hours’ notice will be charged in full and cannot be rescheduled or refunded.
  • Group Lessons & Courses (In-person / Online): Due to fixed scheduling, missed group classes cannot be refunded or rescheduled. Where feasible, study materials for missed lessons will be provided.
  • Cancellations by Spanish Circle: If we must cancel a session due to tutor illness or unforeseen technical/venue circumstances, we will offer an alternative date/time or a pro-rata refund/credit for that session.

6. Student Conduct & Acceptable Use

We aim to foster a safe, inclusive, and respectful learning environment for all students and tutors.

  • Students are expected to behave respectfully toward tutors and fellow participants during in-person and online classes.
  • Spanish Circle reserves the right to remove any participant from a class or terminate services without refund if their behavior is disruptive, abusive, or discriminatory.

7. Intellectual Property Rights

All teaching materials, worksheets, website content, branding, logos, and course structures are the exclusive intellectual property of Spanish Circle or its licensors. You are granted a non-exclusive, non-transferable license to use materials solely for your personal educational purposes. Materials must not be reproduced, shared, or resold without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by Scottish and UK law:

  • Spanish Circle provides services with reasonable skill and care, but does not guarantee specific linguistic fluency milestones.
  • We are not liable for business losses, indirect damages, or loss of technical access caused by third-party software, internet interruptions, or venue failures beyond our reasonable control.
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or fraud.

9. Governing Law & Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Scotland. You agree that the courts of Scotland will have exclusive jurisdiction to resolve any disputes.
